Can you get a new loan while under debt review in South Africa? The National Credit Regulator (NCR) says consumers cannot apply for or be granted new credit while undergoing debt counselling. The process is meant to restructure existing debt, not provide another loan. The NCR says a consumer becomes eligible to apply for new credit after a debt counsellor issues a clearance certificate. Eligibility to apply still does not mean a lender must approve an application.
What does debt review do?
Debt counselling is a formal process for qualifying over-indebted consumers. A registered debt counsellor assesses the finances and may negotiate a rearranged repayment plan with credit providers. The NCR’s debt-counselling explanation says it is not a savings scheme, has fees and requires enough disposable income for a repayment arrangement. It is different from having a low credit score or one missed instalment.
What if a payment is unaffordable now?
Tell your registered debt counsellor promptly which payment you cannot meet and ask how the existing arrangement can be addressed. Keep statements, due dates and written messages from the lender. If a job loss, disability or another covered event is involved, ask whether your particular agreement includes credit-life insurance and what its conditions say; cover is not automatic. How do you check your status and counsellor?
Ask for your debt-counselling application, repayment proposal, any court or tribunal order and your counsellor’s registration number. The NCR says registered debt counsellors have an NCRDC number, which you can check through the NCR register. If you believe the status is wrong or someone promises instant removal for a fee, do not rely on an advert; contact your counsellor and the NCR to clarify the record and process.
When can you apply for credit again?
The NCR says the restriction continues during debt counselling and that a clearance certificate is the route to becoming eligible to apply again. Ask your counsellor what must be settled under your own arrangement and for a copy of the certificate when issued. A later application will still be assessed by the provider, including affordability and its current criteria. Do not interpret a “debt review loan” or “guaranteed approval” search result as proof that new credit is available while the process remains active.
